MJ Training — Training Program Waiver and Release

MJ Training · Waiver version 1

Training Program Waiver and Release

MJ Training · Version 1.0 · October 2026

This waiver is between you and MJ Training (the “Coach”), owned by Coach MJ. It applies to every training program you buy from the Coach and use in the APEX app (the “Program”). APEX Coach AI, Inc. delivers the Program but is not the seller and is not part of this waiver. APEX’s Terms of Service apply separately, and nothing in this waiver limits your rights under them, including Section 8.D (refunds and access).

If you are under 18, a parent or guardian must accept this waiver for you. “You” then means both of you.

1. How the Program works

  • The Program is a remote, self-directed training plan. The Coach does not supervise your sessions in person.
  • You choose where, when and with what equipment you train.
  • Loads, sets and reps are starting points. Adjust them to how you feel on the day.

2. Your health

  • Talk to a physician before you start, especially if you have a medical condition, an injury or symptoms such as chest pain or dizziness, are pregnant, take medication, or haven’t exercised regularly in the past year.
  • You confirm that you are physically able to do the Program, or that a physician has cleared you.
  • Stop right away and get help if you feel pain, faintness, shortness of breath or any other warning sign. In an emergency, call 911.
  • Nutrition guidance in the Program is general information, not an individualized meal plan or medical advice.

3. Risks you accept

Strength, speed and conditioning training has real risks, even when done correctly. They include:

  • muscle strains, sprains, tendon and ligament injuries, dislocations and fractures;
  • injuries from equipment, falling weights or your training space;
  • overuse injuries, fatigue and soreness;
  • in rare cases, heart problems, heat illness, serious injury or death.

You understand these risks and choose to accept them.

4. Your responsibilities

  • Learn and use correct technique. Use a spotter and safety equipment for heavy lifts.
  • Check that your equipment and training space are safe before each session.
  • Train within your ability, and enter accurate information (such as your maxes) so the Program’s loads fit you.
  • Follow the Program’s instructions and contact the Coach through the app with questions.

5. Release

To the fullest extent the law allows, you release the Coach and the Coach’s business, owners, employees and assistants from any claims for injury, illness, death or property damage that arise from your use of the Program, including claims based on their ordinary negligence. This release does not cover gross negligence, willful misconduct or anything else the law doesn’t allow to be released.

6. Indemnity

To the extent the law allows, you will cover the Coach’s reasonable costs if a claim is brought against the Coach because you broke this waiver or misused the Program.

7. Parents and guardians

If you accept for an athlete under 18:

  • You confirm that you are the athlete’s parent or legal guardian.
  • You give permission for the athlete to do the Program, and you accept this waiver for yourself and for the athlete.
  • You understand that some states limit releases on behalf of minors. This waiver applies to the fullest extent the law where you live allows.

8. General

  • This waiver is governed by the laws of California.
  • If any part of it can’t be enforced, the rest still applies.
  • It stays in effect for as long as you use any of the Coach’s Programs.
  • You accept it electronically by checking the box at checkout, and that acceptance has the same effect as a signature.
